Acceptance of Terms
By accessing or using ARK ARK ("the Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Application.
These Terms apply to all users of the Application, including healthcare professionals, students, researchers, and general users accessing the medical reference information.
Open Source License
ARK ARK is free and open source software licensed under the GNU Affero General Public License v3.0 (AGPL-3.0). This license grants you the freedom to use, study, modify, and distribute the software.
Under the AGPL-3.0 license, if you modify the Application and make it available over a network (including as a web service), you must make the complete source code of your modified version available to users. This ensures that improvements to the software benefit the entire community.
The Application may also be available under commercial dual licensing for organizations that prefer alternative licensing terms. For commercial licensing inquiries, please contact us.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
The developers, contributors, and distributors of ARK ARK shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use the Application, including but not limited to damages from medical decisions, misdiagnosis, treatment delays, or adverse health outcomes.
This limitation applies regardless of the legal theory on which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise. Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so these limitations may not apply to you.
